AI discipline & termination notices under CA SB 947

SB 947 (Stats. 2026, ch. 859) is operative July 1, 2027 (Lab. Code §1526.7). This module is marked “coming” until then.

When

An employer that “primarily relied upon” an automated decision system (ADS) for a discipline or termination decision must give a written notice “at the time the employer informs the employee of the decision” (§1524(a)).

What the notice says (§1524(b))

  • An ADS was primarily relied on.
  • A human reviewed and corroborated the output.
  • A human contact, and the right to a description of the employee's own data.
  • No retaliation.

Format

Plain language, separate and stand-alone, in the language you routinely use, by email, hyperlink or another simple written format. The State publishes no template; ours is a draft, labeled as such, for your attorney to review.

HR-system hook

Post decisions from your HR or performance system to our API. Sending is blocked unless a human has corroborated the output (§1522(c)).

Penalty

“a civil penalty of five hundred dollars ($500) per violation” (§1526.1(e)), plus remedies in civil actions.

Retention

We found no statutory retention period. The default is a configurable 4 years; confirm with counsel.
